
New City, N.Y. — A Rockland County jury has convicted a Chestnut Ridge man on multiple felony charges stemming from the sexual assault of an 8-year-old child, following an eight-day trial in Rockland County Court.
Rockland County District Attorney Thomas E. Walsh II announced that Byron Gutierrez-Rosil, 55, was found guilty on July 8 after a jury trial before Judge Kevin F. Russo. The defendant was convicted on all charges contained in the indictment, including two counts of Predatory Sexual Assault of a Child, two counts of First-Degree Rape, two counts of First-Degree Sexual Abuse, and two counts of Endangering the Welfare of a Child.
Following the verdict, the court ordered Gutierrez-Rosil remanded to the Rockland County Jail without bail pending sentencing. Sentencing is scheduled for Oct. 7, 2026.
According to the District Attorney’s Office, the investigation began after the child disclosed the alleged abuse to her mother on Sept. 2, 2025. Prosecutors said the child reported that the abuse occurred on two occasions, July 19 and July 20, 2025, while she was at the defendant’s home. The allegations included vaginal sexual abuse and sexual intercourse.
The Ramapo Police Department conducted the criminal investigation that led to the defendant’s arrest and prosecution.
During the trial, prosecutors presented evidence over the course of eight days before the jury returned guilty verdicts on every count in the indictment. The District Attorney’s Office stated that the convictions carry significant prison exposure under New York law.
If sentenced on the predatory sexual assault convictions, Gutierrez-Rosil faces a mandatory minimum sentence of 10 years to life in prison and a maximum possible sentence of 25 years to life. The exact sentence will be determined by the court at the October sentencing hearing.
In announcing the verdict, District Attorney Walsh praised the child for testifying during the trial and thanked the investigators and prosecutors involved in the case. He stated that his office remains committed to prosecuting crimes involving the sexual abuse of children and pursuing justice for victims.
The case was prosecuted by Supervising Assistant District Attorney Gerard Damiani III and Senior Assistant District Attorney Brittany Richardson of the Rockland County District Attorney’s Office.
Predatory Sexual Assault of a Child is among the most serious felony offenses under New York law. The charge applies in cases involving certain aggravated sexual crimes committed against children and carries the possibility of a life sentence upon conviction.
The conviction concludes the trial phase of the case, although the criminal proceedings will continue through sentencing. The defendant remains in custody at the Rockland County Jail while awaiting his Oct. 7 court appearance, where Judge Russo will determine the appropriate sentence under New York law.
