HAVERSTRAW, NY – The Town of Haverstraw has recently passed a local law, making significant amendments to its zoning code to accommodate the presence of cannabis businesses. This development outlines four distinct categories for cannabis enterprises, each with its own unique role:
- Retail Dispensaries: Retail dispensaries, specializing in the sale of cannabis products, will now be permitted to operate as-of-right in the C-Commercial Zones. These zones primarily encompass areas near West Ramapo Road and a section of Thiells-Mt. Ivy Road.
- Paraphernalia Shops: Paraphernalia shops, which offer accessories related to cannabis use, also fall under the as-of-right category within the C-Commercial Zones.
- Industrial Businesses: Industrial cannabis businesses, which encompass cultivators, growers, processors, distributors, cooperatives, and microbusinesses, will be located in the Town’s PIO-Planned Industrial Office District. This district includes locations such as Cambridge Plaza and a section off Quaker Road, opposite the Hudson Valley Humane Society.
- On-Site Consumption Lounges: On-site consumption lounges are now part of the approved cannabis landscape in Haverstraw. These lounges, where individuals can consume cannabis products, are also permitted within the PIO-Planned Industrial Office District, with the same geographical boundaries.
The new regulations also come with specific requirements to ensure the responsible operation of these businesses. These include mandatory site plan approval from the Town Planning Board, with a focus on security, disposal, and odor control. Outdoor seating or congregation areas are prohibited. Additionally, there are minimum distance requirements:
- Consumption lounges must be at least 1,000 feet away from any residence, school, day care center, medical facility, parkland, commercial recreation site, or house of worship.
- Retailers must maintain a minimum distance of 500 feet from other cannabis businesses and existing or operating schools and day care centers.
These measures are aimed at balancing the presence of cannabis businesses with the needs and safety of the Haverstraw community. The Town is taking proactive steps to ensure that the introduction of these businesses aligns with local priorities and regulations.
