NEW CITY, N.Y. — Rockland County District Attorney Thomas E. Walsh II announced that a 32-year-old Village of Haverstraw resident pleaded guilty Feb. 24, 2026, to multiple felony weapon possession charges and resisting arrest.
Daquan Kelly entered a guilty plea before Judge David M. Ascher to Criminal Possession of a Weapon in the Second Degree, Criminal Possession of a Weapon in the Third Degree, and Resisting Arrest.
According to the District Attorney’s Office, on July 24, 2025, at approximately 11 p.m., Kelly was found in possession of a loaded firearm. Authorities said that when officers attempted to take him into custody, he twisted his body, flailed his legs and threw himself to the ground, refusing to be placed into a police vehicle.
Prosecutors noted that Kelly has prior convictions, including a 2022 conviction for Criminal Contempt in the Second Degree, a 2015 felony conviction for Attempted Robbery in the Second Degree, and a 2012 felony conviction for Robbery in the Third Degree.
Kelly is scheduled to be sentenced on June 9, 2026. The prosecution recommended a sentence of 10 years in state prison. The court is expected to impose eight years on the top count of Criminal Possession of a Weapon in the Second Degree, two to four years in state prison on the third-degree weapon possession charge, and one year on the resisting arrest charge. The sentences are anticipated to run concurrently.
“I commend the officers for their vigilance and swift action in taking this individual into custody,” Walsh said in a statement.
The case was investigated by the Town of Haverstraw Police Department with assistance from the Rockland County Sheriff’s Department and prosecuted by Executive Assistant District Attorney Michael Peterson.
