New York’s Court of Appeals upheld a lower court decision that the Town Board had illegally adopted the law nine years ago without putting it up for a public referendum. Hoehmann was a councilman at the time the law was adopted and had voted for it back then. Hoehmann and GOP Chairman Lawrence Garvey could run in a primary and then the winner would face off against town clerk, Democrat Justin Sweet. Hoehmann said he’ll be making an official announcement about his future in the coming days.
